Holiday Order Terms & Conditions

Effective for all orders placed for pickup between October 22, 2025, and January 15, 2026.

These Holiday Order Terms & Conditions ("Holiday Terms") are an addendum to our standard Terms of Service. During this high-volume period, these Holiday Terms supplement and, where there is a conflict, override our standard policies.

By placing a holiday order with ShidaSweets, you agree to the following:

1. Holiday Order Cancellation and Refund Policy

ALL SALES ARE FINAL. Due to the high demand, custom preparation, and procurement of seasonal ingredients, we cannot offer cancellations or refunds for any holiday orders once they have been placed and payment is received.
This policy overrides our standard cancellation policy. No refunds will be issued if we have begun preparation, which may start immediately, or if you miss your scheduled pickup.

2. Rescheduling Policy

If you need to request a change to your pickup date, you must contact us directly at [email protected] at least 7 days to your confirmed pickup time.
We will do our best to accommodate a one-time reschedule request, subject to our kitchen's availability. Rescheduled orders must be for a new date within 30 days of the original pickup date.
We cannot guarantee that all rescheduling requests will be granted, especially those made with less than 72 hours' notice.

3. Pickup Windows

You agree to pick up your order during the specific 1st, 2nd, or 3rd choice time slot that we confirm with you.
Orders not picked up during the confirmed window are not eligible for a refund or reschedule, as they are perishable.

4. Agreement

Placing an order and checking the "Holiday Terms" agreement box on our order form constitutes your full acceptance of these terms.

Welcome to ShidaSweets! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "customer") and ShidaSweets ("we," "us," or "our") concerning your access to and use of the ShidaSweets.com website (the "Site") and our services.

By using our Site and placing an order, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you must not use our Site or services.

Our Services

ShidaSweets provides custom, made-to-order pound cakes. All orders are subject to acceptance and availability. Submitting an order form is a request and does not form a binding contract until we have confirmed the order with you and received payment. We generally require at least one week's notice for orders but will do our best to accommodate requests with shorter turnaround times.

Orders, Payment, and Cancellations

Order Process: To place an order, you must submit a request through the form on our Site. We will then contact you to confirm the details and provide an invoice for payment.
Payment: All orders must be paid in full before cake preparation begins. We utilize trusted third-party payment processors (e.g., Stripe) to handle transactions securely.
Cancellation and Refund Policy: Due to the custom, perishable nature of our products, all sales are final.
- Cancellations: If you need to cancel an order, please contact us immediately. A refund may be possible only if we have not yet begun preparing your cake or purchasing specific ingredients.
- No Refunds: We cannot offer a refund once cake preparation has begun. Preparation may start up to 72 hours before the agreed-upon fulfillment date. A missed pickup or a change in your schedule does not qualify for a refund.

User Reviews and Testimonials

We love to hear from you! If you submit a review, testimonial, comment, or photo to us (collectively, "Contributions"), you grant ShidaSweets a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, and display such Contributions in our marketing and promotional materials, including on our website and social media pages. We will only identify you by your first name or as otherwise agreed upon. You are solely responsible for your Contributions and agree not to post anything that is false, offensive, or infringes on the rights of others.

Prohibited Activities

You may only use our Site for its intended purpose. You agree not to:

Use the Site for any illegal or unauthorized purpose.
Attempt to impersonate another user.
Harass or threaten any of our team members or other users.
Interfere with the proper working of the Site or its security features.
Use any information from the Site to harass, abuse, or harm another person.

Intellectual Property

All content on this Site, including our name, logo, text, and photographs ("Content"), is our proprietary property and is protected by copyright and trademark laws. You are granted a limited license to access the Site for personal, non-commercial use. You may not copy, distribute, sell, or otherwise exploit any part of the Content without our prior written permission.

Disclaimer

Our products are prepared in a kitchen that may handle common allergens, including but not limited to wheat, dairy, eggs, and nuts. While we take steps to minimize risk, we cannot guarantee that any of our products are safe to consume for people with severe allergies. THE SITE AND OUR SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS.

Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS OR EMPLOYEES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS.

Indemnification

You agree to indemnify and hold harmless ShidaSweets, its employees, and representatives from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of our services or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting the updated version on our Site, indicated by the "Last Updated" date. Your continued use of our services after any changes indicates your acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
